Welcome to ScanSnap AI. These Terms of Service ("Terms") govern your access to and use of the ScanSnap AI mobile application (the "App") provided by ScanSnap AI ("we," "our," or "us"). Please read these Terms carefully before using the App.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using ScanSnap AI, you confirm that:

You are at least 13 years of age (or the minimum age required in your jurisdiction).
If you are under 18, you have obtained parental or guardian consent to use the App.
You have the legal capacity to enter into these Terms.
Your use of the App complies with all applicable laws and regulations.

2. Description of Service

ScanSnap AI is an AI-powered object identification application that allows users to:

Photograph objects using their device's camera
Receive AI-generated identification and information about those objects
Save scan history and favorites
Access premium features through subscription

The App provides information for educational and entertainment purposes. While we strive for accuracy, AI-generated results should not be relied upon as definitive identification or valuation for important decisions.

3. User Accounts

3.1 Account Creation

Some features of the App may require you to create an account using Sign in with Apple. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized use of your account

3.2 Account Termination

We reserve the right to suspend or terminate your account at any time if you:

Violate these Terms
Engage in fraudulent or illegal activities
Abuse the App or its features
Harass other users or our staff

4. Subscriptions and Payments

4.1 Free and Premium Tiers

ScanSnap AI offers both free and premium subscription tiers:

Free Tier: Limited daily scans with basic features
Premium Tier: Unlimited scans with additional features including value estimates, age & origin information, and material analysis

4.2 Subscription Terms

Premium subscriptions are billed through the Apple App Store. By subscribing, you agree to the following:

Payment will be charged to your Apple ID account at confirmation of purchase
Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel subscriptions in your App Store account settings
Any unused portion of a free trial period will be forfeited when you purchase a subscription

4.3 Refunds

All purchases are processed through Apple and are subject to Apple's refund policies. To request a refund, please contact Apple Support directly through the App Store.

4.4 Price Changes

We reserve the right to change subscription prices at any time. Any price changes will be communicated in advance and will not affect your current subscription period.

5. Acceptable Use

You agree to use ScanSnap AI only for lawful purposes. You shall not:

Use the App for any illegal or unauthorized purpose
Upload or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
Attempt to gain unauthorized access to the App, other users' accounts, or our systems
Interfere with or disrupt the App or servers connected to the App
Reverse engineer, decompile, or disassemble any part of the App
Use any automated means to access the App or collect data
Impersonate any person or entity
Use the App to identify objects for illegal purposes (e.g., stolen goods, contraband)
Circumvent any usage limits or restrictions
Resell or redistribute any part of the App or its services

6. Intellectual Property

6.1 Our Intellectual Property

The App, including its design, features, content, and underlying technology, is owned by ScanSnap AI and protected by intellectual property laws. You may not:

Copy, modify, or distribute any part of the App
Use our trademarks, logos, or branding without permission
Create derivative works based on the App

6.2 User Content

You retain ownership of any photos you take using the App. However, by using the App, you grant us a limited license to:

Process your images for AI analysis
Store metadata related to your scans
Use anonymized, aggregated data to improve our services

6.3 Feedback

If you provide feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without any obligation to you.

7. Disclaimers

7.1 AI Accuracy

THE AI-GENERATED RESULTS PROVIDED BY SCANSNAPAI ARE FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES ONLY. While we strive for accuracy, the App may produce incorrect, incomplete, or misleading results. You should not rely on the App for:

Professional appraisals or valuations
Medical, legal, or safety decisions
Financial or investment decisions
Authentication of valuable items
Identification of potentially dangerous substances

7.2 No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

WARRANTIES OF MERCHANTABILITY
FITNESS FOR A PARTICULAR PURPOSE
NON-INFRINGEMENT
ACCURACY OR RELIABILITY OF RESULTS
UNINTERRUPTED OR ERROR-FREE OPERATION

7.3 Third-Party Content

The App may display information obtained from third-party sources. We do not guarantee the accuracy, completeness, or reliability of such information.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

SCANSNAPAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM
WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR RELIANCE ON AI-GENERATED RESULTS
WE SHALL NOT BE LIABLE FOR ANY LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

9. Indemnification

You agree to indemnify, defend, and hold harmless ScanSnap AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

Your use of the App
Your violation of these Terms
Your violation of any rights of another party
Your violation of any applicable laws or regulations

10. Changes to the App and Terms

10.1 App Changes

We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice. We shall not be liable for any modification, suspension, or discontinuation of the App.

10.2 Terms Changes

We may update these Terms from time to time. We will notify you of material changes by:

Posting the updated Terms in the App
Updating the "Last updated" date
Sending a notification through the App (for significant changes)

Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

11. Termination

You may stop using the App at any time by deleting it from your device. We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination:

Your right to use the App will immediately cease
You will not be entitled to any refunds
Provisions that by their nature should survive termination will survive (including disclaimers, limitations of liability, and indemnification)

12. Governing Law and Disputes

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

12.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation, it shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

12.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ScanSnap AI regarding the App.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

13.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

13.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control.

14. Apple-Specific Terms

The following additional terms apply to your use of the App on Apple devices:

These Terms are between you and ScanSnap AI only, and not Apple. ScanSnap AI, not Apple, is solely responsible for the App and its content.
Your use of the App must comply with the App Store Terms of Service.
Apple has no obligation to furnish any maintenance or support services for the App.
Apple is not responsible for addressing any claims relating to the App.
Apple is not responsible for the investigation, defense, settlement, or discharge of any intellectual property infringement claim.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
